1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and MAG JET Aviation Services. By using our website or engaging any of our services, you represent that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with these Terms and all applicable laws and regulations.
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
2. Nature of Our Services
MAG JET operates as a private aviation services company offering aircraft charter brokerage, jet card programs, aircraft acquisition and sales brokerage, aircraft management, aviation fuel services, and aircraft detailing.
Charter brokerage. When arranging charter flights, MAG JET acts as your agent or broker, connecting you with FAA Part 135-certificated air carriers who serve as the direct air carrier for your flight. MAG JET is not itself an air carrier and is not responsible for the direct operation of any aircraft. The certificated air carrier bears all operational responsibility, including safety of flight, regulatory compliance, and direct air transportation.
Brokerage services. When acting as a buyer's or seller's broker for aircraft transactions, MAG JET facilitates the transaction and does not take title to any aircraft. Any aircraft purchase or sale is directly between buyer and seller. MAG JET makes no warranty, express or implied, regarding the airworthiness, condition, or value of any aircraft.
3. Website Use
You may use our website for lawful purposes only. You agree not to:
- Use our website in any way that violates applicable local, state, national, or international law or regulation
- Transmit any unsolicited or unauthorized advertising or promotional material
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website
- Attempt to gain unauthorized access to any part of our website, servers, or networks
- Use any automated means (bots, scrapers, crawlers) to access or index our website without our express written permission
- Introduce malicious code, viruses, or other harmful materials
We reserve the right to terminate or restrict your access to our website at any time and for any reason, without notice.
4. Quotes, Pricing, and Bookings
All charter quotes provided by MAG JET are estimates based on information available at the time of quoting and are subject to change based on availability, fuel prices, applicable fees, and other market factors. A quote does not constitute a confirmed booking.
A charter booking is confirmed only upon execution of a written charter agreement between you and the applicable air carrier (or, where applicable, MAG JET on behalf of the carrier), and receipt of any required deposit or payment. Terms of individual charter agreements, including cancellation policies, payment terms, and operational terms, are governed by the specific agreement for each booking.
All prices are in United States Dollars unless otherwise specified in writing. MAG JET reserves the right to correct pricing errors at any time.
5. Cancellations and Refunds
Cancellation terms, fees, and refund eligibility are governed by the specific charter agreement, jet card agreement, or service contract executed for each engagement. These terms vary depending on the aircraft type, lead time, operator, and service involved.
As a general principle, charter flights cancelled close to departure involve greater non-recoverable costs (crew positioning, aircraft deadheads, slot reservations) and therefore typically involve higher cancellation fees. Specific terms will be clearly disclosed in your booking agreement before any payment is required.
For aircraft brokerage transactions, any deposits or earnest money arrangements are governed by the purchase agreement negotiated in your transaction, not these general Terms.
6. Intellectual Property
All content on the magjet.net website — including text, images, graphics, logos, design elements, and the overall look and feel — is owned by or licensed to MAG JET Aviation Services and is protected by applicable copyright, trademark, and other intellectual property laws.
You may access and view our website content for personal, non-commercial use only. You may not reproduce, distribute, modify, publicly display, create derivative works from, or otherwise exploit any content from our website without our prior written permission. Limited excerpts may be shared with appropriate attribution for non-commercial, editorial purposes.
The MAG JET name, logo, and related marks are trademarks of MAG JET Aviation Services. Nothing on our website grants you any license or right to use our trademarks without our express written permission.
7. Disclaimer of Warranties
OUR WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE.
MAG JET makes no warranty that our website will meet your requirements, be available at any particular time or location, be secure or error-free, or that any defects will be corrected.

8. Limitation of Liability

IN NO EVENT SHALL MAG JET'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR WEBSITE EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO MAG JET IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. To the extent such limitations are not permitted by applicable law, the above limitations may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless MAG JET Aviation Services and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of our website or services; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) your negligence or willful misconduct.
10. Third-Party Services
Our website may contain links to or integrations with third-party websites, platforms, or services. These links are provided for convenience only. MAG JET does not endorse, control, or assume responsibility for the content, privacy practices, or conduct of any third-party website or service. 12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or your use of our website or services shall first be subject to good-faith negotiation between the parties.
If a dispute cannot be resolved through negotiation, it shall be resolved by binding arbitration in Texas in accordance with the rules of the American Arbitration Association. Judgment on any arbitration award may be entered in any court having jurisdiction. Each party shall bear its own costs in any arbitration proceeding, except that the arbitrator may award costs and fees to the prevailing party in egregious circumstances.
Notwithstanding the foregoing, either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. You agree that any claim arising from your use of our website must be brought within one (1) year of the event giving rise to the claim or be forever waived.
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIM SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A CLASS ACTION OR COLLECTIVE PROCEEDING.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible.
14. Entire Agreement
These Terms, together with our Privacy Policy and any written agreements executed between you and MAG JET for specific services, constitute the entire agreement between you and MAG JET Aviation Services with respect to the subject matter hereof and supersede all prior or contemporaneous understandings, communications, and agreements.
